1. How to Make a Purchase
1.1. Entering all details on the order page is a prerequisite for making a purchase in the store (“the online store website”). After filling in all details, the participant becomes a “person carrying out an action.” To ensure the order is processed quickly, efficiently, and without errors, all details must be provided accurately.
1.2. The person carrying out the action will be charged for the cost of the ordered product or service via credit card, after the transaction is approved by the credit card companies.
1.3. A customer requesting self-pickup at the factory store will be charged the full order amount (a product cannot be reserved without full payment).
1.4. The details entered on the registration page, as well as the transaction record in the store’s computerized system, shall constitute conclusive proof of the correctness of the actions.
1.5. Responsibility for entering correct details rests solely with the customer. The online store bears no responsibility for incorrect details that were entered.
1.6. Providing false details is a criminal offense; anyone who does so may be subject to criminal and civil legal proceedings.
1.7. If the transaction is not approved by the credit card company, the person carrying out the action will receive appropriate notice within 96 hours, and the order will be deemed cancelled.
1.8. For further details and inquiries, you may contact the store directly by phone and/or email: 02-590-0577, info@tekhelet.com
2. Cancellation of a Transaction (Applies only to orders placed as distance-selling transactions through the online store or by phone)
2.1. As a general rule, the customer may cancel the transaction subject to and in accordance with the provisions of the Consumer Protection Law, 5741-1981.
2.1.1. Policy on returning products not due to a defect, in distance sales:
2.1.2. This policy applies to transactions carried out on the store’s website (distance selling) and to transactions carried out by phone only.
2.2. When the transaction was carried out in person (a customer with a salesperson at the factory store), the governing product return policy is the policy published at the factory store.
3. Returning a Shelf Product
3.1. A shelf product purchased in the store and/or ordered by phone may be returned within up to 14 days from the date of receipt of the product, for a credit or a full refund, provided the following cumulative conditions are met:
3.1.1. The product was returned in its original packaging and there was no significant deterioration in the product and/or its packaging.
3.1.2. The product was not used in any way.
3.1.3. Subject to statutory cancellation fees and the store’s policy.
4. Returning a Product Assembled/Made to the Customer’s Specifications
4.1. A product that was assembled according to the customer’s wishes and requirements cannot have its purchase cancelled and/or be returned (if it was already delivered to the customer) and/or exchanged, except to the extent that a manufacturing defect is found in one of its components, or in the event of a discrepancy between the product supplied and what was agreed upon in the order.
4.2. Notwithstanding the above, and without derogating from the foregoing, the Company may (but is not obligated to) cancel a purchase transaction of a product assembled to the customer’s specifications even in the absence of a manufacturing defect and/or discrepancy, beyond the strict letter of the law and at its sole discretion.
4.2.1. A cancellation at the Company’s discretion is conditional on the store’s laboratory inspection finding that the product was returned intact and unused. In such a case, the Company may charge the customer a cancellation fee totalling 10% of the transaction cost.
4.3. In any case of cancellation and credit, the Company will credit the customer in the manner in which they paid. In the case of cash payment, the refund will be by cash check sent to the customer’s address by registered mail within up to 14 days from the date of cancellation or return. Credit cards will be credited via the credit card company.
4.4. Any case of cancellation, credit, and/or exchange is conditional on presenting the original invoice for the purchase.
4.5. Under no circumstances can the product be returned if more than 14 days have passed since the date of receipt of the product.
4.6. If the product was delivered to the customer, the customer is responsible for returning the product to the Ptil Tekhelet factory store, whole, intact, and in its original packaging (together with the original invoice). If, within the first 14 days from receipt of the shipment, the customer suspects the product is defective, the customer must come to the Ptil Tekhelet factory for inspection. If the product is found to be defective, the customer may receive a new product, or alternatively a refund, with no refund of shipping costs.
4.7. Shipping fees will be collected before the product is shipped, together with the order. It is agreed that proof of shipment constitutes conclusive evidence that the customer received the product.
5. Cancellation of a Transaction by the Store
The store shall be entitled to cancel a transaction or sale, in whole or in part, in the following cases:
5.1. If an error occurred in the presentation of the item in the store and/or in the shipment of the product to the customer, whether in the product’s price or in the product’s description and specifications.
5.2. If it is discovered that a communications malfunction and/or any other technical problem occurred that disrupted the product’s price and/or description.
5.3. In the event of prevention and/or delay due to force majeure, such as, but not limited to: acts of war, hostilities, terrorism, cyberattack, an intentional or unintentional malfunction of the store’s website, strikes and shutdowns, extraordinary natural events, credit card clearing malfunctions, and any other reason not resulting from an act or omission of the store; and also any case in which the store decided, at its discretion, that there is a concern the purchase is being made as part of a wholesale purchase and/or that the products are being purchased for resale by the buyer or anyone on their behalf.
5.4. If the product runs out of stock in the online store’s warehouse, after or before a sale was made (but before shipment to the customer).
5.5. When there is a concern, at the store’s discretion, that payment for the purchase will not be received.
6. Delivery of Products
6.1. The store will arrange for delivery of the product or service purchased on the website to the address entered on the order page, within the timeframe stated on the product’s sales page, unless explicitly stated otherwise.
6.2. The store will act to deliver the product by courier mail within up to 6 business days, or by registered mail within up to 10 business days, subject to full payment by credit card.
6.3. The store will not be liable for a delay in delivering the product due to circumstances amounting to force majeure as detailed in Section 5.3 above and/or circumstances beyond its control.
